So it went with one of our clients in the newspaper post press industry.  The client and their long time patent lawyers discovered that two of the company’s major competitors were infringing the patent covering the company’s newest technology on its high speed inserting and saddle stitching machines.  The client knew that large scale infringement litigation was imminent, and that it called for an additional skill set beyond the technical expertise of the patent lawyers.  They hired us to prosecute litigation against the two accused infringers.  In successive Markman hearings, we faced off against the patent lawyers representing the two defendants.  Using skills honed through decades of complex litigation, we took the highly complicated engineering and computer technology claimed in the patent and presented it to the judges in both cases in clear and persuasive terms that they, as nonexperts in the technology, could understand and appreciate.  We won a virtual clean sweep in both hearings, setting the stage for a favorable settlement in one case and significant summary judgment victories followed by a favorable settlement in the other.
